MaxVolts Terms of Service

Last updated: September 16, 2026

Agreement and eligibility

These Terms govern your use of MaxVolts, operated by MaxPoints LLC, doing business as MaxPoints (“MaxPoints,” “we,” “us,” or “our”). The Services include container deployments, application hosting, infrastructure connections, domains and HTTPS configuration, and cloud worker resources. By using the Services, you agree to these Terms. You must be at least 18 and legally able to enter this agreement. If acting for an organization, you must have authority to bind it.

Other MaxNova services

A shared MaxAuth account can connect participating MaxNova services, but each service has its own scope, permissions, eligibility, and terms. Signing in does not purchase a subscription or authorize every connected action. The terms for another service apply when you use that service; your accepted order controls its specific scope and billing commitments.

Deployments and infrastructure authorization

You authorize MaxVolts to pull the container images you select, run workloads, apply configuration and secrets, route traffic, and manage the infrastructure actions you request. Connected cloud-provider permissions may allow provisioning, resizing, restarting, or deleting resources. Review the affected resources before confirming an action and grant only the permissions needed.

You are responsible for your applications, images, dependencies, licenses, secrets, access controls, and the lawfulness of hosted content. A health check verifies only the checks performed; a successful deployment is not a security audit or guarantee that your application functions correctly.

Resources, availability, and backups

Hosting is limited to the resources and features included in your accepted plan. Shared or dedicated placement, CPU, memory, storage, traffic, and worker capacity depend on that plan; no dedicated server or unlimited capacity is promised unless expressly included. Resource exhaustion, restarts, maintenance, provider failures, and application errors can cause interruption.

Treat container-local files as temporary unless persistent storage is expressly configured. Maintain independent backups and verify recovery for databases, uploaded files, configuration, and other data you need. Database hosting, backup retention, disaster recovery, uptime guarantees, and service credits apply only where expressly included in your agreement.

Custom domains require your authorization and correct DNS configuration. Propagation and certificate issuance can take time or fail. Managed HTTPS does not secure application code or replace your obligation to protect data.

Usage charges and ending hosting

You are responsible for charges you authorize under your hosting plan and any separate cloud-provider accounts or add-ons. Stopping a container, disconnecting a provider, or deleting a project may not cancel an external subscription or remove every billable resource. Review billing and resource inventories with the relevant provider.

Nonpayment, plan expiry, or abuse may interrupt workloads and associated workers. Before ending hosting, export needed data and arrange a replacement service. Storage or resources may be removed after termination under the applicable plan and retention requirements; ongoing retention is not promised unless expressly agreed.

Hosting acceptable use

Do not host malware, phishing, unlawful content, unauthorized scanning or attacks, credential theft, spam infrastructure, or workloads that evade limits or compromise other tenants. You must have authorization to test any system. We may restrict workloads that threaten platform security or availability, and will provide notice where reasonably practicable.

Your information, accounts, and rights

You retain ownership of information and materials you provide. You represent that you have the rights and permissions necessary to provide them and request the related processing. You grant MaxPoints a non-exclusive, worldwide, royalty-free license to host, process, reproduce, and transmit them as reasonably necessary to provide, secure, and support the Services, follow your instructions, and comply with law, subject to applicable backup and legal retention requirements.

Provide accurate account information, protect credentials, and promptly report unauthorized activity. You may not access another account or system without authorization, infringe third-party rights, evade safeguards, or interfere with the Services. Any separately applicable open-source license continues to govern the material it covers.

Connected providers and service termination

Third-party integrations are governed by their own terms, permissions, and charges. Only connect accounts and resources you are authorized to use. We may restrict or suspend access for nonpayment, violation of these Terms, legal requirements, or threats to security or other users. Where reasonably practicable, we will give notice of a material suspension or discontinuation.

You may stop using the Services, but must separately cancel any subscriptions or renewals you no longer want under the applicable purchase terms. Export information you need before closing an account. Accrued payment obligations and provisions that by their nature survive termination remain effective. Mandatory consumer rights are preserved.

MaxPoints intellectual property

The Services and the software, designs, text, graphics, logos, documentation, and other materials provided by MaxPoints (“MaxPoints Content”) are owned by MaxPoints or its licensors and are protected by intellectual property and unfair competition laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for their intended purposes.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, create derivative works from, or otherwise exploit MaxPoints Content except as expressly permitted by us in writing, by an applicable open-source license, or by law. Nothing in these Terms transfers ownership of MaxPoints intellectual property to you.

Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES, INCLUDING INFORMATION AND OUTPUTS, ARE PROVIDED “AS IS” AND “AS AVAILABLE.” MAXPOINTS DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES OR THEIR OUTPUTS WILL BE UNINTERRUPTED, SECURE, ACCURATE, COMPLETE, ERROR-FREE, OR SUITABLE FOR YOUR NEEDS OR LEGAL REQUIREMENTS.

Some jurisdictions do not allow certain warranty disclaimers, so some exclusions may not apply to you. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MAXPOINTS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, SUCCESSORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, USE, CODE, CREDENTIALS, OR DATA, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

These limitations do not apply to liability that cannot be limited or excluded under applicable law. Your use of the Services is at your own risk, and you are responsible for the information, permissions, configurations, and instructions you provide and the decisions and actions you take based on the Services.

Governing law and dispute resolution

These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, and by applicable federal law, including the Federal Arbitration Act where applicable.

Before starting formal proceedings, you and MaxPoints agree to attempt in good faith to resolve the dispute informally for at least 30 days after one party gives the other written notice. Notices to MaxPoints must be sent to 18121 E Hampden Ave Unit C #1244, Aurora, CO 80013.

If the dispute is not resolved informally, it will be resolved by binding arbitration on an individual basis, except that either party may bring an eligible claim in small claims court or seek injunctive relief for actual or threatened infringement or misuse of intellectual property. The arbitration will take place in Colorado, or remotely if the arbitrator permits, under the Colorado Uniform Arbitration Act and applicable federal law. Each party will be responsible for arbitration fees only to the extent permitted by applicable law and the rules selected by the arbitrator.

Waiver of class actions

To the fullest extent permitted by law, you and MaxPoints agree that each may bring claims only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. If this waiver is found unenforceable for a particular claim, that claim must be resolved by a court of competent jurisdiction and not in arbitration.

Changes to these Terms

We may update these Terms as the Services or legal requirements change. We will revise the last-updated date and provide notice of material changes before they take effect, with additional consent where required by law. Changes do not retroactively alter accepted charges or resolve an existing dispute on new terms. Continued use after the stated effective date constitutes acceptance only to the extent permitted by law.

General terms

These Terms and any applicable accepted order govern the Services. Specific order terms control the scope, price, and duration of that order. Nothing here excludes rights or liability that cannot lawfully be excluded. If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver.
